LACMA is strongly committed to protecting the privacy of its members, visitors, donors, customers, attendees of its events and programming, and guests (online and offline). LACMA does not collect personal information about individuals—such as names and postal and/or email addresses—except when it is knowingly provided by such individuals.

Information LACMA Collects

LACMA ensures that the collection, management and storage of any personal information provided by You to the museum will be completed in accordance with all applicable legal requirements.

How LACMA Uses Information LACMA Collects From You

LACMA uses information collected from You to personalize its websites to better suit the needs of its online guests; to provide its services to its visitors, members, donors, and other guests (e.g., ticketing, membership, programming, events and other activities); to comply with applicable legal requirements; to contact You regarding the museum, its services and third party organizations that may be of your interest; and to enhance the museum’s information security and resolve reported issues. LACMA may also use this information to contact You about museum programming, events, activities, fundraising and membership opportunities.

LACMA may share Your personal information with third parties for the same purposes, and the third parties will only be permitted to use Your personal information as instructed by LACMA. LACMA will never share with third parties who are not service providers to the museum any financial information You provide when purchasing a membership or making a donation. However, the museum may aggregate personal information so that such information is no longer identifiable with an individual. LACMA will use such aggregated information for any purposes in connection with its nonprofit mission, and such aggregated information will not be considered personal information. If You would prefer to not have Your information shared in this way, please send an email message containing Your name and postal address to @email. More information about opting-out from receiving emails and/or other messages from LACMA can be found under LACMA Email, Text Message and Phone Call Policy.

Cookies

LACMA uses technology known as “cookies” to authenticate users, track usage patterns, traffic trends and user behavior, as well as to record other information from the websites and/or platforms. For certain services provided on LACMA’s websites and other LACMA platforms, cookies allow the museum to save information locally so that users do not have to re-enter the information the next time they visit the websites and/or platforms. Additionally, certain “cookies” are strictly necessary for the websites’ and/or platforms’ functioning. The information the museum collects will only be used in the aggregate to make content adjustments and other customer service improvements. LACMA contracts with third party vendors for services that require the sharing of non-personally identifiable information collected with cookies.

Transactions

LACMA follows industry standard for information security. All credit card information submitted to LACMA will be encrypted using "Secure Sockets Layer" (SSL) software, so it cannot be read as the information travels over the Internet. LACMA will retain Your membership information for its records. LACMA engages third parties to process all transactions conducted on the websites and at LACMA’s facilities. Such third parties have represented to the museum that LACMA, its patrons and customers are protected by security features, including encryption and tokenization, designed to prevent the unauthorized release of your personal financial data. Such third parties have further represented to the museum that all credit card information complies with current PCI standards and will be tokenized and held on third party sites.

Although LACMA endeavors to create secure and reliable websites, the confidentiality of any communication or material transmitted to or from the websites over the Internet cannot be guaranteed. You assume the sole and complete risk of using the websites, and You must make your own independent determination of the foregoing. LACMA is only responsible for information after receipt and while in the museum’s custody.

Information collected by LACMA will be processed and stored where the museum’s service providers are located. Your information may be processed outside of your country and/or state of residence. Your information will be subject to the policies and procedures of these service providers.

LACMA understands that it may collect personal information from minors under the age of 18 (name and optionally an email and/or phone number) in connection with its educational programming, activities and events, including through NexGenLA, which is a free membership program at the museum for children under the age of 17 who live in the County of Los Angeles.  LACMA will not knowingly collect any personal information from children under the age of 13 without the express consent of that child’s parent or legal guardian. Any personal information collected from children in connection with NexGenLA will be used solely for creating a user membership in this program and managing their participation in the program. Once the participant has aged out of NexGenLA, LACMA will contact the participant to ask if the participant would like to opt-into LACMA’s mailing lists.

If a participant, parent or legal guardian would like to request that LACMA remove the participant from its lists, please email @email with the participant’s name and email and/or phone number if previously provided to the museum.

Access to and use of the Site are subject to the following terms and conditions ("Terms and Conditions") and all applicable laws. By accessing and browsing the Site, You accept, without limitation or qualification, the Terms and Conditions and other notices and acknowledge full and complete acceptance of these Terms and Conditions.

TERMS AND CONDITIONS

Conditions of Use:  Access to and use of LACMA's Content (as defined below) on this Site are subject to the following Terms and Conditions:

1. The text, images, and data, including without limitation audio and video clips, software, documentation, and other information contained in the files on this Site (collectively, the "Content") are either (1) images of works from LACMA's permanent collections that LACMA believes are in the public domain, some of which are made available without restriction (these images are marked "Public Domain High Resolution Image Available" as described below); or (2) protected by copyright (the "Protected Content"). Such Content, whether or not in the public domain, may be subject to other restrictions as well, including rights of privacy and publicity, under applicable law.

a. "Public Domain High Resolution Image Available": The Content on the Site marked "Public Domain High Resolution Image Available" consists of images of works from LACMA's permanent collections that are currently available in "high resolution" format and that LACMA believes are in the public domain. LACMA is providing high resolution images of these works free of charge and for use without restriction. The Public Domain High Resolution Image Available mark indicates that LACMA is unaware of any current copyright restrictions on the Content so designated, either because (i) the term of copyright has expired, (ii) no evidence has been found that copyright restrictions apply, or (iii) LACMA owns copyright but would like to share this Content with the public without exercising control as part of the museum’s mission to engage and educate its communities.  LACMA does not warrant that the sharing or other use of this Content will not infringe upon the rights of third parties holding rights to these works, including rights other than copyright, such as rights of privacy and publicity.  It is Your responsibility to determine and satisfy copyright and other use restrictions before downloading, copying, transmitting, publishing or making any other use of these items.  If You have any knowledge about rights holders of any of these works, please contact LACMA's Rights and Reproductions Department at @email or 323 932-5862. b. Protected Content: LACMA and relevant third parties retain all rights, including copyright, in the Protected Content. Users may download and use the Protected Content subject to these Terms and Conditions, and subject to any additional terms or restrictions applicable to the individual file or program, provided all copyright and other proprietary notices contained on the Protected Content are retained. For certain images within the Protected Content on this Site, LACMA has been unable to determine the copyright holder, and the museum would appreciate receiving any information about copyright ownership for appropriate acknowledgement. Please forward such information to LACMA's Rights and Reproductions Department at @email or 323 932-5862.

i. To the extent LACMA owns such rights, the Protected Content is made available for use only for limited non-commercial personal use. Users must cite the author/artist and source of the Protected Content as they would material from any printed or other work, and the citation should include the URL "www.lacma.org" in addition to all copyright and other proprietary notices provided with the Protected Content. In granting this limited permission, however, note that LACMA does not represent or warrant that use of Protected Content displayed on the Site will not infringe the rights of third parties. Copyright and other proprietary rights in the Protected Content, including reproductions of works of art licensed to LACMA by third parties such as artists or artists' heirs/estates holding rights to these works, or images of people or places displayed on the Site, may be held by individuals and/or entities other than LACMA. Use of these images by You is prohibited unless specifically permitted by such third parties.

ii. LACMA expressly prohibits the use, downloading, copying, display, publication, distribution, transmission, modification, reposting or exploitation for commercial or public purposes of the Protected Content, except for the limited purposes described above.

2. While LACMA uses reasonable efforts to include accurate and up-to-date information in this Site, LACMA makes no representations or warranties as to its accuracy. LACMA assumes no liability or responsibility for any errors or omissions in the content of the Site. Use of and browsing in the Site are at Your risk. Without limiting the foregoing, ALL CONTENT ON THE SITE IS PROVIDED "AS IS" WITHOUT A WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND/OR NON-INFRINGEMENT. LACMA assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, Your computer equipment or other property on account of Your access to, use of, browsing in, or downloading of any Content from the Site.

3. Except where specifically indicated otherwise, any communication or material You transmit to the Site by electronic mail or other means, including any data, questions, comments, suggestions or the like is, and will be treated as, non-confidential and non-proprietary. Anything You transmit or post may be used by LACMA or its affiliates or licensees for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast, posting and the like.
